General terms

These terms govern the provision of lighting installation and related services by Qustrava. They set out the relationship between Qustrava and the customer, including obligations, permitted use, and limitations. By engaging Qustrava you accept these terms for the specified service engagement.

Lighting installation safety and design

Eligibility

To use Qustrava services customers must be able to enter into a binding contract under applicable law. Services are intended for lawful purposes and must not be used in a manner contrary to local regulations or building codes.

Customers must be of the age of majority in their province or territory to enter into contracts for services. Minors must obtain consent from a legal guardian or have a guardian act on their behalf.

Services must be used in compliance with all applicable laws, regulations and permits. Customers are responsible for obtaining any permits or permissions required for installation on their property where applicable.

Qustrava provides services primarily within Canada. Availability in other jurisdictions may be limited and subject to local regulations and logistical feasibility.

Account information

Where account creation is required for scheduling or service tracking, customers are responsible for providing accurate information and maintaining the confidentiality of access credentials.

Customers must ensure information provided to Qustrava is accurate and up to date. Incorrect information may affect service delivery or safety assessments.

Customers should safeguard account credentials and notify Qustrava promptly if unauthorized access is suspected. Qustrava implements security measures but is not liable for losses resulting from compromised credentials where reasonable precautions were not taken by the user.

Accounts and access rights are non-transferable without Qustrava's written consent. Transfer requests will be evaluated on a case-by-case basis.

If you believe your account has been compromised, contact Qustrava immediately using the contact details provided. Prompt notification helps protect your data and service arrangements.

Qustrava may suspend access to accounts where there is suspected misuse, security concerns, or non-payment. Where practical, customers will be notified and given an opportunity to resolve issues.

Scope of services

Qustrava provides assessment, installation, maintenance and repair services for residential and commercial lighting systems. Specific deliverables and timelines are set out in service estimates and work orders agreed upon before work begins.

Services may be adjusted by mutual agreement to reflect site conditions or changes in customer requirements. Material changes will be documented in revised estimates or work orders.

Service availability varies by location and schedule. Qustrava will communicate expected service windows and notify customers of any significant delays due to conditions beyond its control.

Rules of conduct

Customers and third parties must follow safety and conduct rules during service delivery to ensure a safe working environment.

  • Provide accurate information about site conditions and access requirements.
  • Ensure work areas are reasonably clear and safe for technicians to operate.
  • Comply with instructions from Qustrava personnel related to safety and equipment operation.
  • Refrain from obstructing or interfering with the performance of scheduled work.
  • Disclose any known hazards, such as asbestos or structural issues, prior to service.
  • Respect Qustrava staff and property during service visits.
  • Notify Qustrava promptly of any concerns regarding workmanship or safety.

Customer-supplied content

Customers may provide specifications, photos or other materials to assist in service delivery. Such materials are considered customer-supplied content.

Customers retain ownership of content they supply to Qustrava. By providing content, customers represent they have rights to share it and that it does not violate third-party rights.

By supplying content, customers grant Qustrava a limited license to use, copy and store that content for the purpose of delivering services and improving operational processes.

Customers are responsible for the accuracy and legality of supplied content. Qustrava is not responsible for issues arising from inaccurate or infringing materials provided by the customer.

Qustrava may remove or refuse to use customer content that appears unlawful, unsafe or otherwise unsuitable for service delivery. Qustrava will communicate such decisions when feasible.

Intellectual property

Qustrava and its licensors retain ownership of all intellectual property rights in site materials, documentation, procedures and proprietary tools used to deliver services. Customers are granted a limited right to use deliverables for their intended purpose.

  • Do not reproduce or distribute Qustrava proprietary materials without authorization.
  • Do not reverse-engineer proprietary software or tools provided by Qustrava.
  • Respect third-party intellectual property included in service materials and follow any applicable licensing terms.

Paid services

Certain Qustrava services are provided for a fee. Fees and payment terms are specified in estimates, invoices or applicable order forms.

Pricing is determined by scope, materials, labour and applicable taxes. Estimates are valid for the period specified and may be adjusted if site conditions differ materially from the information available at the time of estimate.

Payment terms are set out in invoices or the service agreement. Accepted payment methods will be listed in the proposal or invoice. Late payments may be charged interest as permitted by law.

Where recurring services are offered, subscription terms will detail billing frequency, renewal terms and customer cancellation rights.

Refunds and adjustments are handled according to the specific service agreement and applicable consumer protection laws. Qustrava reviews refund requests on a case-by-case basis.

Customers may cancel scheduled services subject to any notice periods or cancellation fees stated in the service agreement. Cancellations should be communicated in writing where feasible.

Applicable taxes will be added to service charges as required by Canadian law and provincial regulations. Customers are responsible for taxes associated with services received.

Qustrava may update pricing for future work. Changes to agreed prices for active projects will be handled in accordance with the terms of the service agreement.

Non-payment may result in suspension of services, collection actions or denial of future services. Qustrava will attempt to notify customers and resolve payment issues prior to such actions.

Information and materials provided by Qustrava are for general informational purposes and to describe services. Site content is provided 'as is' and is not a substitute for professional advice tailored to specific conditions.

Limitation of liability

To the extent permitted by law, Qustrava's liability for direct damages arising from its services is limited to amounts paid for the specific service in question. Qustrava is not liable for indirect, consequential or punitive damages resulting from service use or interruptions.

Third-party services

Qustrava may coordinate with third-party suppliers or subcontractors for certain materials or specialized work. Customers agree that selected third parties may access site information necessary to perform their tasks.

Termination

Either party may terminate the service agreement in accordance with the terms set out in the contract. Termination does not affect accrued rights or obligations such as payment for services already provided.

On termination, Qustrava will invoice for work completed and return customer property where applicable. Certain obligations, such as confidentiality and liability provisions, will survive termination.

Privacy and data protection

Handling of personal data collected in relation to services is governed by Qustrava's privacy policy. The policy describes data collection, use, retention and rights available to individuals.

Communications

Qustrava will communicate by phone, email or postal mail as necessary to arrange services, provide updates and manage billing. Customers should ensure contact information is current to receive timely notices.

Changes to terms

Qustrava may revise these terms to reflect operational or legal changes. Material changes will be communicated in advance where required. Continued engagement after changes indicates acceptance where permitted by law.

Governing law

These terms are governed by the laws of the Province of Ontario and applicable federal laws of Canada. Disputes will be subject to the jurisdiction of courts in Ontario unless otherwise agreed in writing.

Dispute resolution

Parties will attempt to resolve disputes through negotiation. If unresolved, disputes may be referred to mediation or formal legal processes in accordance with the governing law provisions.
